We have on permit on our consent agenda tonight, an indoor LLP permit for Mary’s on Haight. The applicant completed the standard outreach requirements and there was no opposition for the permit. Senior Inspector Zverina has already set an internal sound limit for the business and SFPD Park Station did not have any added conditions for the application. The staff recommendation is to approve the consent agenda with the staff recommendations listed below.

Consent Agenda

a. EC-1930 - Aindreas O'Donnell, Todd Riley, Maria Haught, and Connor Haught of HAUGHT TODDY LLC, dba Mary’s on Haight, 1437 Haight St, Limited Live Performance

Staff recommendation: Approval with:

  1. Permit holder shall comply with San Francisco Municipal Police Code under the jurisdiction of the Entertainment Commission, including but not limited to, Article 15, Article 15.1, Article 15.2, and Article 29; and
  2. Permit holder shall comply with the Commission-approved Security Plan; and
  3. Adhere to Entertainment Commission’s Good Neighbor Policy; and
  4. Indoor entertainment allowed daily 9am – 11pm; and
  5. Sound abatement internal limit approved at 93dBA/96dBC measured from end of booth bench at left after entering.

Regular Agenda

b. EC-1928 - Wissam Habr of SF LAUNDROMAT LLC, dba Hideaway Café, 850 Jones St, Limited Live Performance that includes outdoor amplified sound

The first permit on our agenda tonight is for a Limited Live Performance permit that includes outdoor amplified sound at the front of the business for Hideaway Café, located at 850 Jones Street. Please note that this application was continued from our previous hearing because the applicant didn’t complete the required neighborhood outreach, and although they requested to be continued to tonight’s hearing, the applicant again did not complete the required neighborhood outreach. As such, the staff recommendation tonight is to continue this item to another future hearing date.

Hideaway Café is located inside SF Laundromat and holds a Type 41 liquor license. They have food, beer, wine, and serves as a community gathering space. The owner is applying for the LLP permit so he can host small musical performances including acoustic musicians, bands, DJs, stand up comedy, and drag shows. Additionally, he is seeking the ability to host outdoor amplified sound at the front of the business 9am – 10pm not to exceed 6 hours per day for his sidewalk diners and to drive in foot traffic. Senior Inspector Zverina set a sound limit for the space, and for the amplified sound we are recommending the standard 50 foot condition. SFPD Central Station did not respond to the recommendation request, but I have included their standard calendaring condition in the staff recommendation below since I know that is their standard practice. Here to speak with you tonight is the owner, Wissam Habr.

Staff recommendation: Approval with:

  1. Permit holder shall comply with San Francisco Municipal Police Code under the jurisdiction of the Entertainment Commission, including but not limited to, Article 15, Article 15.1, Article 15.2, and Article 29; and
  2. Permit holder shall comply with the Commission-approved Security Plan; and
  3. Adhere to Entertainment Commission’s Good Neighbor Policy; and
  4. Permit holder shall email monthly calendar of events to SFPD Central Station Permit Officer and the Entertainment Commission the month prior; and
  5. Indoor entertainment allowed daily 9am – 11pm; and
  6. Outdoor amplified sound allowed at the front of the business daily 9am – 10pm not to exceed 6 hours per day; and
  7. Permit holder shall control the volume of outdoor amplified sound so that it does not exceed ambient levels at a distance of 50 feet measured from the property plane; and
  8. Sound abatement internal limit approved at 92dBA/98dBC measured from top of ramp after entering.

c. EC-1929 - Nick Osborne of RUBY'S TACO SHOP LLC, dba Ruby’s, 4300 Judah St, Limited Live Performance that includes outdoor entertainment and amplified sound

The next permit on our regular agenda is for an LLP permit that includes outdoor entertainment and amplified sound for Ruby’s, located at 4300 Judah Street. This is a new, family owned and operated restaurant in the outer sunset that is seeking an LLP permit primarily so they can host small live performances in their parklet. The application before you includes indoor entertainment daily 9am – 9pm, outdoor entertainment in the parklet daily 12pm - 8pm not to exceed 4 hours per day, and outdoor amplified sound Monday - Friday 11am - 8pm and Saturday – Sunday 10am - 8pm. For the outdoor entertainment, they plan to have one musician with an acoustic guitar or violin with a single speaker, and for the outdoor amplified sound, they plan to have one small speaker in each of their two parklets. Senior Inspector Zverina has not set sound limits for the space yet, but when he does, he will be mindful of nearby sensitive receptors when setting the limit in accordance with both Article 29 for indoor entertainment and Article 1060.16 for outdoor entertainment. For the outdoor amplified sound, staff are recommending the standard condition not to exceed ambient at 50 feet from the property plane. The applicant and his wife personally delivered letters to their neighbors within 150’ of the business, and there was no opposition for the permit. SFPD Taraval Station had no added conditions, and here to speak with you tonight is the owner, Nick Osborne.

  4. Indoor entertainment allowed daily 9am – 9pm; and
  5. Outdoor entertainment allowed in parklet daily 12pm – 8pm not to exceed 4 hours per day; and
  6. Outdoor amplified sound allowed in parklets Monday - Friday 11am - 8pm and Saturday – Sunday 10am - 8pm; and
  7. Permit holder shall control the volume of outdoor amplified sound so that it does not exceed ambient levels at a distance of 50 feet measured from the property plane; and
  8. Direct staff to set internal sound limit in accordance with MPC Article 29; and
  9. Direct staff to set external sound limit for live entertainment in accordance with MPC Article 1060.16
