Update to Algorithmic Devices Law

Starting October 6, 2025, tenants’ rights organizations will also be able to file civil lawsuits to enforce the prohibition against Algorithmic Devices.

Currently, under Rent Ordinance Section 37.10C, landlords are currently prohibited from using “algorithmic devices” to set rents or occupancy levels for residential rental units in San Francisco. An “algorithmic device” is software that uses algorithms to analyze non-public competitor rental data to recommend when to keep units vacant or how much rent to charge.

The law is enforced through civil lawsuits filed by the City Attorney or by individual tenants.

What’s changing:
Starting October 6, 2025, tenants’ rights organizations will also be able to file civil lawsuits to enforce this prohibition.
