Filing Petitions for Recognition, Challenging, or Decertification of Union

Any registered employee union can ask to be recognized as the labor union representative of a bargaining unit; another employee labor union may challenge to be the labor union of a bargaining unit; or employees or employee labor unions may file to decertify the union of the unit.

What to do

A bargaining unit is a group of employees that are in similar job classes.   Employees in a bargaining unit can make changes to the employee labor organization that represent them.

1. Fill out form CSC-100

There are 3 types of requests you can make on the form:

  • Recognize: You want an employee labor organization to become the only representative of a group of employees (bargaining unit)
  • Challenge: A different employee labor organization wants to become a bargaining unit's only representative, and the current labor organization doesn't  want them to
  • Decertify: You don't want an employee labor organization to represent your bargaining unit anymore

To complete the form, you can can either:

2. Gather documents that show other employees want this change

You need to provide evidence that at least 30% of the employees in the bargaining unit have agreed to this change in their representation.

If you don't provide this evidence, we will reject your petition.
