Call to order, roll call, and agenda changes

1A. Findings to allow teleconferenced meetings under California Government Code Section 54953(e).

The Task Force is expected to consider a motion setting forth findings required under Assembly Bill 361 (AB 361) that would allow the committee to hold the meeting remotely according to the modified Brown Act teleconferencing set forth in AB 361. (Discussion and Action)

4A. Communication from Member Hill: Consideration of a motion to waive Article II, Section 2 (Attendance) of the Sunshine Ordinance Task Force Bylaws for Member Hill due to his own serious medical condition for the period of September 1, 2022 through April 30, 2023. Discussion and action. 

4B. Complaints Involving the SOTF: Development of procedures for handling complaints naming a single member of the Sunshine Ordinance Task Force, and consideration of standing procedures when an SOTF member, the SOTF as a policy body, or the SOTF Administrator is a party to a complaint. Discussion and action.

Public comment

Members of the public may address the Sunshine Ordinance Task Force (SOTF) on matters that are within SOTF’s jurisdiction, but not on today’s agenda. No action.

Public comment shall be taken at 5 pm or as soon thereafter as possible.

Note: Hearings on complaints and other agenda items listed below will begin no earlier than 5 pm.

Review and consider proposed efficiency edits to the complaint process

(The SOTF initially reviewed this item at its July 6, 2022 regular meeting. It passed motions to provide for further consideration of specific changes and edits to its complaint procedures. This item was continued from the September 7, 2022 hearing to be heard immediately following public comment.)

Proposed bylaws amendments: Consent calendar

Hearing and consideration of proposed amendments to the Sunshine Ordinance Task Force's bylaws from the Rules Committee: Regarding the use of a Consent Calendar. Discussion and action.

File No. 22013: Hearing regarding request for reconsideration of complaint 22013

Complaint filed by Yuli Huang against David Steinberg and Public Works for finding no violation of Administrative Code (Sunshine Ordinance), Section 67.21, by failing to respond to a public records request in a timely and/or complete manner.

(On September 7, 2022, the Task Force moved to find no violation with the caveat that the record would be public if it existed.)

File No. 21109: Hearing regarding request for reconsideration of complaint 18086

Complaint filed by Mark Sullivan against the Mission Dolores Green Benefit District Formation Committee for allegedly violating Administrative Code (Sunshine Ordinance), Section 67.14, by failing to allow video and audio recording filming and still photography of a policy body. 

(On September 28, 2021, the Compliance and Amendments Committee moved to find jurisdiction based on their understanding of the role of Public Works and recommended a reconsideration hearing on the complaint by the SOTF.)

Complaint: File No. 22030

Complaint filed by Gizelle Rabi and Karl Kramer against Karen Fletcher and the Adult Probation Department for allegedly violating Administrative Code (Sunshine Ordinance), Section(s) 67.21 by failing to respond to a request for public records in a timely and/or complete manner.

(On May 17, 2022, the Complaint Committee moved to find that the Sunshine Ordinance Task Force has jurisdiction, that the requested records are public, and referred the matter to the task force for hearing.)

Complaint: File No. 21148

Complaint filed by Jordan Santagata and Karl Kramer against the San Francisco Employees’ Retirement System for allegedly violating Administrative Code (Sunshine Ordinance), Section(s) 67.21, 67.24, and 67.25 and California Public Records Act, Section(s) 6254.26 by failing to respond to a request for public records in a timely or complete manner.

(On July 6, 2022, the Sunshine Task Force discussed the agenda and noted that regarding Item 7, the Petitioner and the Respondent agreed to postpone the matter until the October meeting pending an exchange of records.)

Complaint: File No. 21086

Complaint filed by Anonymous against District Attorney Chesa Boudin and the Office of the District Attorney for allegedly violating Administrative Code (Sunshine Ordinance), Sections 67.21, 67.26, 67.27, 67.25, 67.24 and California Government Code 6254.5 by failing to respond to a public records request in a timely and/or complete manner.

(On October 12, 2021, the Education, Outreach, and Training Committee found that the Sunshine Ordinance Task Force has jurisdiction, that the requested records are public and referred the matter to the task force for hearing with the recommendation that that the task force find a violation of Administrative Code, Sunshine Ordinance, Sections 67.26 by failing to keep withholding to a minimum and 67.27 for citing justifications that do not apply.)

Discussion on the Process and Scope of the 2022 Annual Report

Discussion and action.

(On October 11, 2022, the Rules Committee directed Member Stein to form an Annual Report Ad Hoc Committee composed of less than a quorum of members of the full task force, with the charge of developing the process for completing and disseminating a 2022 Annual Report and accompanying press release for distribution to the BOS, the general public, and local media no later than January 31, 2023.)

Sunshine Ordinance Task Force meetings are currently held online. Each posted meeting agenda includes the video link to attend the meeting.

To help make sure interpreters are available, contact us at least 48 hours in advance of the meeting. (Or 4 pm Friday if the meeting is on a Monday.) Late requests will be honored when possible.

Expected meeting behavior

Any member of the Sunshine Ordinance Task Force may call for order if participants are overly disruptive.

If you're attending a meeting, you should:

  • Stay muted unless speaking
  • When you speak, say your name and avoid interrupting others
  • When in person, also silence the ringer on your electronic devices and take important calls outside

People who engage in threatening or menacing behavior may be asked to leave.

The task force may ask you to leave the meeting if you use electronic devices in a way that interrupts the proceedings. (Chapter 67A of the San Francisco Administrative Code).

Your rights under the Sunshine Ordinance

Government’s duty is to serve the public, reaching its decisions in full view of the public.

Commissions, boards, councils, and other agencies of the City and County exist to conduct the people’s business.

This ordinance assures that deliberations are conducted before the people and that City operations are open to the people’s review.

Lobbying

Individuals and entities who influence or attempt to influence local legislative or administrative action may be required by the San Francisco Lobbyist Ordinance to register and report lobbying activity. (San Francisco Campaign and Governmental Conduct Code 2.100.)

Land use matters

Under the Campaign and Governmental Conduct Code, Section 1.127, a person or entity with a financial interest in a land use matter pending before the:

  • Board of Appeals
  • Board of Supervisors
  • Building Inspection Commission
  • Commission on Community Investment and Infrastructure
  • Historic Preservation Commission
  • Planning Commission
  • Port Commission, or
  • Treasure Island Development Authority Board of Directors

Cannot make a campaign contribution to a member of the Board of Supervisors, the Mayor, the City Attorney, or a candidate for any of those offices, from the date the land use matter began until 12 months after the board or commission has made a final decision.
